Terms of Service
Effective {{EFFECTIVE_DATE}}
These terms are an agreement between you and Oddly Serious Inc. (“we”, “us”), the maker of Scribbit. By creating an account or using Scribbit, you agree to them. Our Privacy Policy explains what we can see and keep.
1. Scribbit
Scribbit is a notes app for your computer. You write on a blank page each day; Scribbit’s on-device AI organizes what you wrote; you can search everything later. An account lets you back up your notes and sync them across your devices, encrypted end to end.
You can use Scribbit without an account. These terms apply to the app either way, and to your account if you create one.
2. Your account
- You need to be at least 16 to create an account.
- You sign in with a code we email you (or with Apple or Google). Keep access to your email account secure: someone who controls it can sign in to your Scribbit account, though they can’t read your notes without one of your devices or your recovery key.
- You’re responsible for what happens on your signed-in devices. If a device is lost, sign it out from another device in Settings → Account.
- One account is for one person.
3. Your notes are yours
You own everything you write, record and add to Scribbit. We don’t claim any rights to it.
To run the service, you let us store, copy and send your encrypted notes between your devices and our servers. That’s all we do with them, and because they’re encrypted with keys only your devices have, we can’t read them.
4. Encryption, your keys and your recovery key
Scribbit encrypts your notes on your devices. This protects you, and it also means:
- We can’t recover your notes. If you lose every device signed in to your account and your recovery key, the notes stored on our servers can’t be decrypted by anyone. Keep your recovery key safe, and keep your own exports if your notes matter to you.
- We can’t see what you store, so we can’t check it, fix it, or restore a single note for you.
- Support can help with your account, billing and the app, but not with the content of your notes.
5. The on-device AI
Scribbit uses AI that runs on your device (Apple Intelligence where available, or open models that run on your computer) to organize, search and transcribe your notes. It helps, but it can be wrong: it may put something in the wrong place, miss a task, mishear a word or summarize something inaccurately. Your original words are always kept exactly as you wrote them, and you can correct or undo what Cleanup does. Don’t rely on it for anything where a mistake could cause harm, such as medical, legal or financial decisions.
Some models Scribbit uses are made by others and come with their own licenses, listed in the app under Settings → About → Acknowledgements. One of them, EmbeddingGemma (used for search by meaning), is provided under and subject to the Gemma Terms of Use. By using Scribbit, you agree not to use Gemma, or anything made with it, for the uses the Gemma Prohibited Use Policy restricts, or in violation of any law.
6. Plans and payment
Free. Backup and sync on one computer, 1 GB for images, files and voice notes, and all of Scribbit’s writing, organizing and search.
Pro. Sync on every computer you use, and 50 GB for images, files and voice notes. Pro costs US$5 a month or US$48 a year, plus any tax that applies where you live. Prices in the app at checkout are the ones that apply.
- Trial. Each account can try Pro free for 14 days, without a card. When it ends, the account goes back to Free unless you’ve subscribed.
- Paying. Payments are handled by Stripe in your browser. Your subscription renews automatically at the end of each month or year until you cancel.
- Cancelling. Cancel any time from Settings → Account → Manage. Pro continues until the end of the period you’ve paid for, then your account is on Free.
- Going back to Free never deletes your notes. If your account is over Free’s limits, your notes stay stored and restorable; only one computer keeps syncing, and new files wait on your computer until there’s room or you choose Pro again.
- Refunds. {{REFUND_POLICY}}
- Price changes. If we change Pro’s price, we’ll tell you at least 30 days before it applies to your next renewal, so you can cancel first.
7. Using Scribbit fairly
Don’t:
- try to get into accounts or data that aren’t yours, or break or get around Scribbit’s security;
- overload, attack or disrupt our servers, or use them for anything other than syncing and backing up your Scribbit notes (for example, as general-purpose file storage);
- use Scribbit to break the law.
You’re responsible for what you store. We can’t see it, so we don’t monitor it; but if we learn that an account is being used to harm others or our service, we may suspend it, and we’ll tell you why unless the law forbids it.
8. The service
We work hard to keep Scribbit running and your notes safe, but we can’t promise the servers will always be available or error-free. Your notes are always kept on your own devices, so you can keep writing when our servers are unreachable, and they sync when they’re back.
We may change or improve Scribbit over time. If we stop offering a paid feature you rely on, we’ll tell you in advance and, where it’s fair, give you a prorated refund. If we ever shut Scribbit down, we’ll give you at least 90 days’ notice and your notes will remain on your devices, exportable.
9. Ending your account
You can delete your account any time in Settings → Account. It deletes your account and everything stored for it on our servers, and cancels your subscription. Your notes stay on your computers.
We may close an account that breaks these terms, after telling you why and giving you a chance to export your notes, unless the law or a serious risk to others or to Scribbit requires us to act at once.
10. Other services
Scribbit works with services we don’t run: Stripe for payments, Apple’s operating system features (Apple Intelligence, speech recognition, notifications, Touch ID), your calendar app, and the websites you link to (for link previews). Their own terms apply to them.
11. Disclaimers
Scribbit is provided “as is”. As far as the law allows, we don’t give warranties beyond those in these terms, including that Scribbit will meet every need, be uninterrupted, or that the AI’s suggestions will be accurate.
12. Limit of liability
As far as the law allows, we aren’t liable for indirect or consequential losses (such as lost profits or lost data you could have exported), and our total liability to you for any claim about Scribbit is limited to the greater of what you paid us in the 12 months before the claim and US$50.
Nothing in these terms limits rights you have under consumer protection laws that can’t be limited by agreement.
13. Law and disputes
These terms are governed by {{GOVERNING_LAW}}. Disputes will be resolved in {{DISPUTE_VENUE}}, unless the consumer protection law where you live gives you the right to bring them there.
14. Changes to these terms
If we change these terms in a way that matters, we’ll tell you in the app or by email at least 30 days before the change takes effect. If you don’t agree, you can stop using Scribbit and delete your account before then.
